1. Overview

Dubbed the “fake news law,” Brazilian Congressional Bill No. 2630/2020 was submitted in an effort to prevent the dissemination of false information on the internet, including deepfakes. The primary objectives of the law are to oversee digital media and prevent the dissemination of false information, potentially damaging to people or democratic institutions.

2. Scope of the law

The law targets distributors as well as producers of those materials. The bill focuses on the production and dissemination of manipulated digital media, especially deepfakes intended to deceive the public. It focuses on material used for political misinformation, scams, or libels. There are exceptions for satire, journalistic publications, or scholarly research, provided that they don’t aim to deceive anyone.

3. Important provisions

The prohibition on the spread of altered content to deceive the public or harm individual reputations demands that platforms have openness policies for the spread of materials, as well as user detection policies for spreading mass messages.

Platform responsibilities: Electronic platforms have a responsibility to track messages sent and have identification and containment policies for the spread of misinformation. They also have to equip their users with reporting tools for suspected materials.

4. Sanctions & Enforcement

The Brazilian Superior Electoral Court (TSE) along with other authorities is responsible for compliance enforcement of electoral laws especially during elections. Subsequent illegal activity may lead to a prison sentence or a fine, as applicable.

5. Key Cases or Precedents

The TSE imposed regulations banning the employment of deepfakes in election campaign processes ahead of the 2024 elections. The action aimed at avoiding the spread of misinformation and keeping the electoral process clean.

6. Evaluation Against International Standards

Brazil is ahead of other countries regarding both electoral integrity and the regulation of AI systems. Brazil’s law also notes deepfakes, but its legislation is remarkable in that it prioritizes platform responsibility and user authentication.

7. Practical Implications

In order to prevent legal proceedings, creators of content have to label manipulated media in a clear manner. Deepfake content victims can report their cases to platforms, which are required to respond in due time. Platforms are required to invest in processes and technology to identify and handle misleading content effectively.

8. Future Prospects

Brazil can make further modifications with the advancement of technology to meet the challenges of AI-generated content. The question of how to optimize user privacy without compromising on the veracity of data circulated on the internet remains debatable.
