Ireland Investigates X Over Age Assurance Measures

Ireland’s media regulator, Coimisiún na Meán, has opened its first formal investigation under the country’s Online Safety Code, examining whether X has implemented effective age assurance and parental controls to protect children from adult-only content.

The investigation follows concerns from the regulator’s Platform Supervision team about the effectiveness of X’s age assurance measures. Under the Code, platforms are required to do what is necessary to ensure that children do not normally see videos containing pornography, extreme violence or gross and gratuitous cruelty.

One issue is that the regulator feels age assurance that relies on self-declaration is not effective. This raises the profile of simple date of birth fields and “I am over 18” prompts, especially if platforms provide access to adult content. More reliable approaches could include facial age estimation, document-based checks, or other age verification technologies that do not compromise privacy.

The investigation will also determine whether X’s parental controls are at the minimum acceptable level, easily accessible, outside users’ control, and clearly displayed when registering an account. The protections are a crucial part of the regulator’s review, as X is for users under 16 and allows adult-only content.

The case highlights a broader regulatory shift from simply having an age gate to proving that age assurance works in practice. If a breach is ultimately established, Coimisiún na Meán can impose sanctions of up to €20 million or 10% of relevant annual turnover, whichever is greater. The investigation itself does not mean X has been found in violation.

For online services globally, Ireland’s action reinforces growing expectations that child-safety systems should combine effectiveness with data minimisation, accuracy, privacy protections, and resistance to common online circumvention attempts.

How Global Regulators Are Strengthening Age Verification Rules

Similar moves have appeared worldwide. The UK’s Online Safety Act requires highly effective age assurance for services allowing pornography. Australia requires age-restricted social platforms to prevent under-16s from holding accounts, while France has enforced age-verification obligations against adult websites. Together, these measures show regulators increasingly demanding stronger, demonstrable age controls.
